THE NANNY BALANCE TERMS AND CONDITIONS

The following Terms and Conditions govern the business relationship between The Nanny Balance, ABN 73917601806 and you the Client and/or Customer:

FOR SERVICE #1: Done for You Package (full nanny placement service)

1. Introduction

a. The following The Nanny Balance Terms and Conditions are a legally binding agreement between you, the Client, and TNB, the Agency.

b. TNB is a referral agency and offers the service of connecting Clients with Candidates through introduction.  TNB bears no responsibility for the employment of the selected Candidate. The Candidate will be employed directly by you, the Client.

c. The abbreviation ‘TNB’ refers to The Nanny Balance, the Agency.

d. The word ‘Client’ refers to the Parent/s engaging the service of TNB.

e. The word ‘Candidate’ refers to the Nanny and/or Home Manager that is introduced to the Client.

2. Client Obligations

a. You the Client agree to offer a minimum of 3 hour shifts to the selected Candidate.

b. You the Client agree to provide an occupationally safe environment at the times the selected Candidate is present in the workplace.

c. You the Client accept that TNB does not provide Domestic Workers Insurance or Public Liability Insurance for the Client and their home, the selected Candidate’s workplace.

d. You the Client accept that TNB does not provide Public Liability Insurance for the Candidates.

e. You the Client agree to add your Candidate to your motor vehicle policy as a nominated driver should they be required to drive your family vehicle.

f. You the Client agree to notify the Agency at the time of employing a Candidate. Candidates are obliged to inform the agency of employee engagement.

g. You the Client are responsible for entering an employment contract with the selected Candidate and accept that all employment obligations and contractual responsibilities are to be met.

3. Placement Fees (all-inclusive) and Terms

a. Permanent full time Nanny / part time Nanny / House Manager $1750 incl. (Fees subject to change at any time without notice)

b. You the Client accept that any outstanding balance of placement fee is due prior to the commencement of selected Candidates’ employment (should you opt for a fast track placement within 4 week period). 

c. In the event of you the Client engaging a TNB Candidate in employment without the Agencys’ knowledge and with the intention of bypassing placement fees, you remain liable to pay the outstanding balance of placement fee.

d. In the event of you the Client opting to disengage with the process placement fee payments already made will not be refunded.  

4. Refunds and Guarantees

a. TNB aims to connect you the Client with exceptional Candidates through extensive interviews, reference checks, personality profiling and screening however there is no guarantee of Candidate reliability, capabilities or qualities offered by the agency. Should you have any concerns please let us know as soon as they arise.

b. In the unusual circumstance where 2 suitable Candidates cannot be introduced to Client within a 4 week period, 50% of placement fee will be refunded.

c. TNB Nanny Guarantee Period:  In the event of the dismissal or resignation of a permanently employed Candidate within the first 60 days of employment, TNB will provide ONE (1) replacement introduction process free of charge, should the following TNB requirements be met:

c.1. The full original placement fee was paid.

c.2. The notification of termination of employment sent to the agency by Client in writing within 7 days of termination.

c.3. The Candidate has not resigned due to unreasonable Client expectations.

c.4. The Client has not altered the employment conditions which were originally agreed upon by Client and Candidate on employee engagement.

c.5. The Candidates working conditions and treatment by Client were satisfactory.  

c.6. The Agency member/s treatment by Client was satisfactory.

5. Liability and Indemnity

a. TNB reserves the right to terminate a Client Agency agreement should it come to their attention that the selected Candidate has been mistreated or working in an environment that is deemed unsafe. This will be considered a Clients breach of Terms and Conditions. In this event, TNB will not issue any refunds of placement fees previously paid.

b. TNB reserves the right to terminate a Client Agency agreement at any time should the Clients expectation become unreasonable.

c. TNB acts as an agent for the Client and is not an employer of the selected Candidate.  We accept no liability or accountability for any accident, injury, theft, damage, malpractice, expenses or compensation incurred or suffered by the selected Candidate, Client or any other persons.

6. Confidentiality

a. You the Client agrees that all communication either verbal or written between the Agency, Clients and Candidates shall remain strictly confidential unless prior approval is granted.

b. You the Client agree to maintain confidentiality and will not disclose the identity of Candidates introduced by TNB to any third parties unless prior approval is granted.

7. Privacy Policy

a. TNB will not sell or disclose Client and/or Candidates personal information or identification to any third parties.

b. All communication between Agency, Client and Candidates collected either verbally or written by TNB is considered classified and confidential.  TNB agrees not to disclose to any third parties.

c. Sharing untrue, inaccurate or illegal information is strictly prohibited could result in prosecution.

FOR SERVICE #2: Done with You Package (50/50 nanny placement service)

1. Introduction

a. The following The Nanny Balance Terms and Conditions are a legally binding agreement between you, the Client and TNB, the Agency.

b. TNB is a referral agency and offers the service of connecting Clients with Candidates through introduction.  TNB bears no responsibility for the employment of the selected Candidate. The Candidate will be employed directly by you, the Client.

c. The abbreviation ‘TNB’ refers to The Nanny Balance, the Agency.

d. The word ‘Client’ refers to the Parent/s engaging the service of TNB.

e. The word ‘Customer’ refers to the Parent/s who have purchased a TNB product.

f. The word ‘Candidate’ refers to the Nanny and/or Home Manager that is introduced to the Client.

2. Client Obligations

a. You the Client agree to offer a minimum of 3 hour shifts to the selected Candidate.

b. You the Client agree to provide an occupationally safe environment at the times the selected Candidate is present in the workplace.

a. Permanent full time / part time Nanny / House Manager $950 incl (Fees subject to change at any time without notice)

b. You the Client accept that any outstanding balance of placement fee is due prior to the commencement of selected Candidates’ employment (should you opt for a fast track placement within 4 week period).

c. In the event of you the Client engaging a TNB Candidate in employment without the Agencys’ knowledge and with the intention of bypassing placement fees, you remain liable to pay the outstanding balance of placement fee.

d. In the event of you the Client opting to disengage with the process your 50% placement fee deposit will not be refunded. 

4. General

a. Guide titles purchased cannot be returned, printed, refunded, or exchanged.

b. Should you the Customer experience technical difficulty in downloading or accessing a title, please contact TNB team for assistance at hello@thenannybalance.com.

c. You the Customer are permitted to download or store portions of our guide/s but this copy is personal to you, non-exclusive and non-transferrable.

d. Full-scale reproduction of the contents of our guides is expressly prohibited.

e. The Customer may not distribute unauthorised copies of our guides, or use, copy, modify, remove, delete or transfer our guides, in whole or in part, unless you receive our express permission from TNB.

5. Terms of Use

a. You the Customer granted the right to download the guide that you have purchased.

b. You the Customer may print pages of our guides for your personal use and reference.

c. You the Customer agree to protect our guides from unauthorised use, reproduction, or distribution.

d. You the Customer further agree not to translate, decompile, or disassemble our guides except to the extent permitted under applicable law.

e. Multi-use configurations or network distribution of the guide/s is expressly prohibited.

6. Refunds and Guarantees

Should you have any concerns please let us know as soon as they arise.

FOR PRODUCT #1: Done by You Package (DIY Nanny Connection Guide)

1. Introduction

a. The abbreviation ‘TNB’ refers to The Nanny Balance, the Author.

b. The word ‘Customer’ refers to the Parent/s who have purchased a TNB product.

2. General

a. Guide titles purchased cannot be returned, printed, refunded, or exchanged.

b. Should you the Customer experience technical difficulty in downloading or accessing a title, please contact TNB team for assistance at hello@thenannybalance.com.
